The Carré on bags, for sale on this online store and through third-party retailers, are designed and produced by MM33. The accessories are made by reusing vintage silk scarves, selected from private individuals and specialized suppliers.
The scarves are processed and reassembled into a new and original product, which in no way refers to third-party goods.
The Carré on line gives new value to the individual elements that make up the bag, renewing them and completing them with unique distinctive signs.

Anyone accessing or using this website agrees without restriction to be bound by the conditions specified herein. If they do not accept them or do not intend to be bound by them, they cannot access, use or download material from this site.
At any time, MM33 reserves the right to update or vary these conditions and the methods of use of the website, without any obligation of prior notice. In the event of changes to the conditions, access to the website implies the commitment to comply with the conditions as modified.

GENERAL CONDITIONS OF SALE

1. DEFINITIONS AND GENERAL PROVISIONS

The terms and phrases listed below have the meaning indicated below, it being understood that terms defined in the singular are also understood to be defined in the plural and vice versa.

  • Customer: means any entity (natural or legal person) that purchases one or more Products through the online Store, accepting the General Conditions.
  • MM33 with registered office in Milan, Via Panfilo Castaldi 8, registered in the Milan Business Register, tax code and registration no. MGRBNL77R69G713Y, registered in the REA of Milan at no. MI - 2600460, VAT no. 11412000967.
  • Parties: means jointly MM33 and the Customers.
  • General Conditions: means these general conditions of sale and any future new versions that may be published in the online Store.
  • Online Store: means the virtual store, managed by MM33 through which it is possible to purchase the Products.
  • Sales Contracts: means the sales contracts concluded, pursuant to art. 3, between MM33 and the Customers through the online Store.
  • Orders: means the purchase orders for the Products sent by Customers, in accordance with the General Conditions and following the procedure referred to in art. 6.
  • Price: means the selling price of the Products as indicated in the online Store corresponding to the Products themselves.
  • Products: means the products published in the online Store for the purpose of their sale.

To place orders on MM33, customers must:

  • Be at least 18 years old
  • Have the necessary requirements to enter into legally binding contracts
  • Have a valid e-mail address
  • Have a valid credit card for payment: Visa, Mastercard, American Express or a verified PayPal account

 

2. SUBJECT

2.1 The General Conditions govern all Sales Contracts and form an integral part thereof.

2.2 MM33 reserves the right to modify the General Conditions at any time, it being understood that those published in the online Store at the time of sending Orders by Customers will be considered applicable to Sales Contracts.

2.3 In case of conflict between the General Conditions and any other terms and conditions relating to the Sales Contracts published in the online Store, the terms and conditions most favorable to Customers will apply.

 

3. CONCLUSION OF SALES CONTRACTS

3.1 MM33 undertakes to send Customers the Order Confirmation within five working days of receiving the Orders from Customers.

3.2 The Sales Contracts are considered concluded between the Parties when the Customers receive the Order Confirmation. If Customers do not receive the Order Confirmation within the term indicated in art. 3.1, the relative Order must be considered rejected by MM33 and, therefore, without effect.

3.3 By sending the Orders, Customers declare that they have read all the instructions inherent to the method of purchase of the Products referred to in art. 6 and have fully accepted the General Conditions as well as having read all the additional information contained in the online Store, also referred to via link.

3.4 Orders will be stored in the online Store database, according to the methods and in compliance with the provisions of Legislative Decree 30.06.2003 n. 196 ("Privacy") and will be accessible by contacting MM33 at the references referred to in art. 16.

 

4. PRODUCT AVAILABILITY

All product orders are subject to availability. In this sense, in case of supply problems, or if there are no items in stock, we reserve the right to provide you with information regarding replacement products of equal or higher quality and value, which the Customer may decide to order. If you do not wish to place an order for such replacement products, MM33 will reimburse all amounts eventually already paid.

If individual supply items, even if illustrated on the site, are not available for any reason, MM33 will exclude them from the order, keeping the other individual items unchanged. The Customer, by placing the order, agrees and accepts that only part of the goods can be sent, at the relative cost.

 

5. REFUSAL TO PROCESS AN ORDER

We reserve the right to remove any product from this website at any time and/or to delete or modify any material or content thereof. Although we will always do our best to fulfill all orders, exceptional circumstances may arise that force us to refuse to process orders after sending the Order Confirmation, and we reserve the right to do so at any time. We decline all responsibility towards You or third parties for the removal of any product from this website, for the deletion or modification of any material or content of the website, or for the failure to process the order after sending the Order Confirmation.

 

6. PRICE AND SHIPPING COSTS

6.1 The Price is expressed in €. (Euro). The applicable Price is that published in the online Store at the time of sending Orders by Customers.

6.2 The Price includes VAT (22%).

 

7. PURCHASE METHODS

7.1 Ordering is very simple!

  • Log in with your data or register your account if you are a new Customer.

  • You will receive an order confirmation by email.

7.2 Each order transmitted to MM33 is equivalent to a contractual proposal from the Customer, therefore it is binding on MM33 only if:

  • It is complete in all its parts.
  • It is confirmed and accepted by MM33 through its fulfillment.

MM33 reserves the right not to accept incomplete orders or those lacking the necessary data for their fulfillment.

7.3 The fiscal documentation required by law will be issued by MM33 at the time of shipment of the ordered products to the Customer.

7.4 It is not possible to make changes once an order for available items has been placed.

 

8. PAYMENT METHODS

8.1 When an order is placed, credit card details are entered into a secure online payment system provided by Paypal. Payment can be made via credit card or Paypal account

8.2 The information received by MM33 pursuant to this art. 8 will be used exclusively to complete the procedures relating to the sale of the Products and for refund procedures in case of exercise of the right of withdrawal referred to in art. 10 by Customers.

8.3 MM33 reserves the right to cancel any order that has not been paid within five days of receipt.

 

9. SHIPPING TIMES AND COSTS

9.1 Without prejudice to the provisions of the previous article 4 and save where extraordinary circumstances occur, we undertake to do everything in our power to fulfill the order as quickly as possible.
The Customer will then receive an email of shipment with the relative tracking information, so as to monitor the delivery status and any delays due to adverse weather conditions or customs events.
The estimated shipping times are as follows:

EUROPE
Delivery in 2-5 working days

REST OF THE WORLD
Delivery in 3-6 working days

 

Shipping times are provided for reference only. Please note that in some remote areas the delivery service is limited.
MM33 cannot be held responsible for delays due to deliveries to remote areas or adverse weather conditions. During sales or holidays, the high volume of orders and shipments may cause delivery delays.
Orders received on Saturday and Sunday will be processed from Monday.

Storage or return costs, which arise from the non-delivery of the order, will be charged to the Customer, in cases where the personal data is incorrect, ambiguous, or missing fundamental parts that prevent normal delivery. Any customs duties will be charged to the Customer.

9.2 Standard, insured shipping is free on all products. Once the destination is reached, the product is no longer covered by insurance.

9.3 International shipments may be subject to customs duties and import taxes not included in the selling price and for which MM33 is not aware and cannot be held responsible. Please contact the competent local authorities for information.

9.4 Shipments destined for European Union countries are not accompanied by invoices or documents indicating the value of the goods. Shipments destined for countries outside the European Union, as required by customs regulations, are accompanied by invoices or documents indicating the value of the goods.

9.5 Upon receipt of the order, the customer is required to check the integrity of the package before signing the delivery receipt. Our packages are carefully closed and sealed with personalized adhesive tape. If the package is damaged, the customer must accept the package with reservation or refuse delivery.

9.6 Any complaint due to damage, missing goods or errors in the destination address must be notified within 72 hours of the delivery of the order, on the website of the delivery carrier.

 

10. RIGHT OF WITHDRAWAL

10.1 If the Customers are "Consumers" (i.e. a natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out), Customers have the right, pursuant to and for the effects of art. 64 of Legislative Decree no. 206/2005, to withdraw from the Sales Contracts within 30 days from the date of receipt of the Products subject to the Sales Contracts. The right of withdrawal must be exercised by Customers by sending MM33 a written communication, via e-mail to the address referred to in art. 16, containing:

  • The expression of the will to avail oneself of the right of withdrawal;
  • The indication of the Order that gave rise to the Sales Contract from which they intend to withdraw.

10.2 In case of exercise by Customers of the right of withdrawal referred to in this art. 10:

  1. Customers undertake to return the Products within 10 working days from the date of the withdrawal communication referred to in art. 10.1;
  2. All costs related to the return of the Products are entirely borne by the Customers, including customs duties and transaction fees, which will be deducted from the refund;

III. MM33 undertakes to refund the Price as soon as possible, and in any case within 30 days from the date of receipt of the Products referred to in art. 10.2 provided that:

  • The Products have been returned and are intact;
  • The original packaging/box of the Products is also returned and is intact;
  • The Products have not been used;
  1. MM33 will inform Customers of the methods for refunding the Price and may, for this purpose, request their bank details (IBAN and account holder).
  2. Any differences in the refund amount due to exchange rate fluctuations cannot be refunded.

10.3 If Customers exercise their right of withdrawal in a manner that does not comply with the methods and terms set out in this art. 10, Customers are not entitled to a refund of the Price.

10.4 MM33 cannot be held responsible for adverse events during the return shipment such as loss, theft or damage to the goods.

10.5 Items sold on promotion cannot be returned.

 

11. DEFECTS / NON-CONFORMITY OF PRODUCTS

11.1 "Consumer" Customers (as defined in art. 10.1) may request remedies from the seller, within the term referred to in art. 132 of Legislative Decree 206/05 (Consumer Code), for defects in conformity of the Products existing at the time of delivery of the good.

For the purposes of this contract, consumer goods are presumed to be in conformity with the contract if, where relevant, the following circumstances coexist:

  • they are suitable for the use for which goods of the same type are habitually used;
  • they conform to the description made by MM33 and possess the qualities of the good that MM33 presented to the consumer as a sample or model;
  • they show the usual quality and performance of a good of the same type, which the consumer can reasonably expect, taking into account the nature of the good.

In the event of a lack of conformity, the Customer may request, alternatively and free of charge, under the conditions indicated below, the repair or replacement of the purchased good, a reduction in the purchase price or the termination of this contract, unless the request is objectively impossible to satisfy or is excessively burdensome for MM33 pursuant to art. 130, paragraph 4, of the Consumer Code.

The request, accompanied by the relevant purchase receipt and photographic documentation of the non-conformity elements, must be sent in writing, by email to hello@mm33.it, to MM33, which will provide a written response within ten working days and will indicate as soon as possible its availability to process the request, or the reasons that prevent it from doing so. In the same communication, if MM33 has accepted the Buyer's request, it must indicate the shipping or return methods of the good and the expected term for the return or replacement of the defective good.

Signs of wear due to normal or excessive use are excluded from the warranty.

It should also be noted that leather is a material that may naturally present some irregularities and that the scarves come from vintage collections and may show minimal signs of previous use. These signs and irregularities cannot be covered by the warranty.

MM33 declines all responsibility for the possibility that, due to a particular configuration of the computer used by the customer or its malfunction, the colors of the products displayed on the site may have slight differences compared to the originals.

 

12. PRODUCT LIABILITY

MM33 is responsible for any risk related to the Products, until the moment of delivery.

 

13. PRIVACY

MM33 declares and guarantees that the personal data of Customers will be processed in accordance with the provisions of Legislative Decree 196/03, and subsequent amendments.

 

14. INTELLECTUAL PROPERTY

All intellectual property rights connected to the online store (including its contents) are the exclusive property of MM33; the online store and its contents cannot be reproduced either totally or partially, transferred by electronic or conventional means, modified, linked and used for any purpose without the prior written consent of MM33.

 

15. APPLICABLE LAW

15.1 The General Conditions and the Sale Contracts are governed by Italian law (and in particular by Legislative Decree 206 of 06/09/2005 - which in articles 50 to 67 regulates distance contracts - and by Legislative Decree 70 of 09/04/2003 on electronic commerce) and must be interpreted in light of this.

15.2 For any dispute that may arise in connection with the General Conditions and/or the Sale Contracts, the Court of Milan will have exclusive jurisdiction.

15.3 MM33 does not guarantee in any way that the content of the site complies with the regulations in force in other countries.

Your privacy is important to us and in this context, this Privacy Policy describes the procedures followed by MM33, in relation to the processing of personal data collected through its website www.mm33.it (the "site") and, in particular, aims to inform you about the type of data collected, the methods by which they are collected, the purposes for which they are processed and the legal basis of the processing itself.
Your personal data will be processed in full compliance with your rights and fundamental freedoms, and their confidentiality, integrity, availability, security and resilience will be respected.

  • WHAT PERSONAL DATA WE COLLECT AND FROM WHAT SOURCES THEY ORIGINATE:
    MM33, through its site, collects and stores the following categories of personal data:
    Common personal data, including data voluntarily provided by you for the creation of an account, filling out an online form, such as personal and contact data (e.g. first and last name, email address and/or mobile number, password, residential address);
  • Browsing data collected during the visit to the website, whose transmission is implicit in the use of internet communication protocols. The processing of data for the purposes under 5), 6), 7), and 8) does not require the consent of the data subjects as it is necessary for the pursuit of a legitimate interest of the Controller, pursuant to art. 6, co. 1, lett. f) of the GDPR. 
Finally, it should be noted that the optional, explicit and voluntary sending of e-mails to the addresses with the @mm33.it extension indicated on this site by its very nature entails the subsequent acquisition of the sender's address, necessary to respond to requests, as well as any other personal data included in the message. The legal bases for this processing are, therefore, the legitimate interest of the Controller to respond to communications received or the need to fulfill pre-contractual requests made by the data subject. The data will be stored for the time strictly necessary to satisfy any requests from the sender or questions submitted therein to the Controller and, in any case, for the time imposed by specific legal provisions.

IS IT MANDATORY TO CONSENT TO THE PROVISION OF YOUR DATA?
The provision of data for the purposes indicated above is optional but necessary either to manage and process your requests, to fulfill legal and contractual obligations of MM33 or to pursue the legitimate interests of the Controller. In all these cases, failure to provide the data will make it impossible to follow up on your requests, establish commercial relationships with the Controller and carry out all the activities indicated above. 

WHO CAN ACCESS YOUR PERSONAL DATA AND WHAT ARE THE POTENTIAL CATEGORIES OF RECIPIENTS:
Your personal data will be processed, in compliance with current regulations on the matter, by persons authorized to process it following specific appointment by MM33 and within the scope of the duties assigned to them as employees and/or collaborators.
Your data may also be processed by third parties duly appointed as Data Processors pursuant to art. 28 of the GDPR, such as external collaborators and companies that provide specific instrumental services such as IT service providers for website maintenance, freelance professionals and data processing consultants for the financial and accounting management of the Controller, whose list is always updated and available to the Controller.

The management and storage of your personal data will take place on servers located within the European Union. 

HOW LONG IS YOUR PERSONAL DATA STORED
In relation to the different purposes for which they are collected, personal data will be stored for the time strictly necessary to achieve these purposes and, in any case, in accordance with the current regulatory provisions on the matter. In any case, MM33 will take care to avoid the indefinite use of data by periodically verifying the effective persistence of the interest of the subject to whom they refer.
Personal data received following the voluntary sending of emails to the data controller will be stored for the time necessary to satisfy any requests from the sender or questions submitted therein to the Controller and, in any case, for the time imposed by specific legal provisions.
Browsing data will be stored for a maximum of 24 months. 

THE SECURITY OF YOUR PERSONAL DATA:
The processing of your data will take place using tools suitable for guaranteeing its confidentiality, integrity and availability. Specific security measures are observed to prevent the loss of data, illicit or incorrect use and unauthorized access. The Controller adopts appropriate security measures to prevent unauthorized access, disclosure, modification or destruction of your personal data. 
The processing is carried out on paper and using IT and/or telematic tools, with organizational methods and logic strictly related to the indicated purposes.
